LAW PORTAL

The Law Portal provides an easy to use and cost effective means to start the legal process against delinquent debtors. The application is aimed but not limited at Schools, Rental agents, Doctor’s Rooms, Pharmacies (all businesses!).

The Portal will allow the Debtors Clerk access to start legal action at a fraction of the cost.

The process:

- Import/capture the debtor’s details (name and address) and the debt (amount and cause);

- On submission of the details: debtor has 48 hours to respond and will incur minimal ring fenced cost.
  - - Sms to debtor: Letter of Demand (LOD)
  - Email to debtor: Letter of demand (LOD)

After 48 hours:
- - Formal LOD delivered via registered post.
- SMS and email outlining the legal process that will follow.

Online reporting tools will further give the Debtors Clerk the ability to manage the debt by providing summarized information of his debtor’s book. This will allow him/her to make informed decisions on the next steps of the process thereby increasing his/her collection percentage.

The portal is user friendly and do not take any skills other than a basic understanding of the collection process (Guidelines are provided).

DEBT COLLECTION

We have leading software in the debt collection industry that enables us to:

1. Manage large quantities of new debtors on a monthly basis via a “real time batch function” with regards to the importing of data, printing of documents, status change and fee calculation in terms of the Magistrates’ Courts Act (Act 32 of 1944). This function enables us to:

1.1 Process a large quantity of files with precision;

1.2 Limit human error and operate more time effectively.

2. Manage files statuses by age via a “status duration function” that enables us to:

2.1 Monitor and identify files in a certain status according to internal business policy based on years of practical experience in the debt collection industry;

2.2 Manage pro actively.

3. Create “dynamic management tools” in order to accommodate the constant changing demands of clients and magistrate courts as well as the managing of staff on the principle of effectivity.

Pricing and Cost

Our collection policy is based on the “NO COLLECTION– NO FEE”principle. This means that we do not charge fees or disbursements on debts that we cannot collect.

The only cost incurred by the client will be the agreed upon commission percentage (plus VAT) charged on successfully collected debts (Contingency fees in terms of the Contingency Fees Act, No. 66 of 1997).
This commission will be automatically deducted from the monthly remittance to the client (Or as otherwise stipulated in the Service Level Agreement with the client).

Take note of the following:

1. Each debtor is managed individually. In the event of a successful recovery the debtor will be held responsible for payment of the costs he/she incurred, charged in terms of Annexure “A” of the Magistrates’ Courts Act 32 of 1944.
In the event of an unsuccessful recovery, Koegelenberg Attorneys will bear the risk of the disbursements incurred.

2. Our clients will not be held responsible for payment of any attorney fees or -expenses, unless:

2.1 a debtor is wrongfully handed over by the client (Administrative error by client, e. g. debtor already paid in full / fraud);

2.2 a client receives payment from a debtor already handed over for collection, and fails to deposit such payment into our trust account or fails to inform our offices of such a payment;

2.3 certain circumstances specified in the Service Level Agreement (if any), present themselves.
